The results of an independent investigation into whether Nicola Sturgeon violated the Ministerial Code were released and will be released on Monday, the Scottish Government has confirmed

An inquiry by James Hamilton has looked into whether Scotland’s First Minister “tried to influence the conduct of the inquiry” and whether it misled Parliament

He has also checked whether she should have recorded calls and meetings with Mr Salmond, and possibly pondered whether she extended the defense of a government judicial review initiated by her predecessor against legal advice

Mr. Hamilton, former Director of the Public Prosecutor’s Office in the Republic of Ireland, is the Scottish Government’s independent advisor on the Ministerial Code – a set of rules governing the conduct of Ministers

The current First Secretary referred to him after Mr Salmond successfully challenged the Scottish Government’s unlawful investigation into harassment complaints against him, which resulted in him being 512£ 250 in legal fees has been awarded

Mr. Hamilton was originally asked to investigate allegations that Ms. Sturgeon “failed to return the basic facts of meetings and discussions with Alex Salmond to her private office under Section 422 and 423 of the Code”

Ms. Sturgeon, who denies breaking the code, has previously promised that the report will be made public on the day the government receives it

And on Monday afternoon, a government spokesman said, “The Scottish Government received the Independent Advisor’s report this morning, which will be released today once the statutory reviews and notifications are completed”

Sections of the report may be edited by the Scottish Government to avoid puzzling the female complainants and to comply with court orders, the spokesman said

Mr. Hamilton’s investigation was suspended in early 2019 to avoid prejudice against criminal proceedings against Mr. Salmond

He was acquitted of 13 charges, including sexual assault, indecent assault, and attempted rape, following a trial in the High Court in March 2020 The investigation into Mr Hamilton was again delayed by the pandemic before resuming in August 2020

The Code states that the Prime Minister is “the ultimate judge of the standards of conduct expected of a Minister” and the appropriate consequences for violations

Speaking outside her home in Glasgow on Monday morning, Ms. Sturgeon said, “I will do what I have been doing every day for the past year – lead the country through a pandemic”
